Terms and Conditions

Welcome to Examo. These Terms and Conditions ("Terms") form a legally binding agreement between you and Examo ("we", "our", "us") regarding your use of the examo.me website, associated mobile and desktop applications, and our AI-powered study tools (collectively, the "Services"). By creating an account or otherwise using the Services, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
1. Eligibility
You must be at least 16 years old to use Examo. If you are a minor under the laws of your country of residence, you may use the Services only with the consent and supervision of a parent or legal guardian. By creating an account you confirm that all information you provide is accurate and that you have the legal capacity to enter into this agreement.
2. The Services
Examo provides AI-powered study tools, including:
- Course-specific summaries and smart notes
- Optional lecture recording, transcription, and summarisation
- AI Tutor (multi-turn chat with course context)
- Cheat sheets and revision aids
- Flashcards generated from your summaries
- Practice questions and exam practice
- Essay assistance
Available features depend on your plan, the course you have added, and your usage limits. We may add, change, or remove features at any time.
Lecture Capture: you must not record a lecture, meeting, or other person unless you have all consent or other legal authority required where the recording takes place. You must keep the visible recording indicator active and must stop recording when permission is withdrawn. Examo does not provide covert recording, voice cloning, or a right to record third parties. You remain responsible for the recording and uploaded content.
3. Plans, Pricing & Rate Limits
Examo offers free access and paid Pro subscription options. Current recurring totals are shown on the Pricing page. The currency, billing interval, eligible discounts, and final amount are confirmed before Stripe checkout.

Rate limits & fair use: Examo enforces per-account limits on AI generations, AI Tutor messages, summary creations, flashcard generations, cheat-sheet generations, lecture-recording minutes, and total tokens consumed. Limits are designed to allow normal, individual study use. Exact quotas may change as we optimise the platform; the current limits are visible in your dashboard and may be enforced via HTTP 429 errors, request queueing, or feature throttling.
Abuse: automated scraping, programmatic access outside our public API, attempts to circumvent rate limits, account sharing, reselling outputs, and any use that imposes disproportionate load may result in throttling, suspension, or termination without refund.
Pricing changes: we may change prices at any time. For active Pro subscribers, price changes apply only at the start of your next billing period and we will notify you by email at least 14 days in advance.
Referral discounts: if you sign up using a valid Examo referral link, or create a new account after opening a valid shared-course link, you may receive a first-payment referral offer. The eligible plan and exact amount or percentage are shown at checkout. Referral discounts do not apply as continuous recurring discounts, cannot be combined with other coupons or promotions, and are limited to one referral discount per new customer.
4. Billing & Subscription
Payment processor: all paid subscriptions are processed by Stripe. Accepted payment methods include Visa, Mastercard, American Express, JCB, UnionPay, Apple Pay, Google Pay, iDEAL, and SEPA Direct Debit. By subscribing you authorise recurring charges on your selected payment method.
Auto-renewal: Pro subscriptions auto-renew at the end of each billing period (weekly, monthly, or annual) at the then-current price, until cancelled.
Cancellation: you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you keep Pro access until then.
Failed payments: if a renewal payment fails, Stripe or the applicable payment provider may retry collection according to the billing settings in effect at that time. If payment cannot be collected, Pro access may end and the account may be downgraded to the Free plan.
Discounts & invoicing: Stripe applies any eligible discount shown at checkout. The final total is confirmed before payment. You can download invoices from your account.
Lecture-minute packs: an optional minute pack is a one-time purchase, not a recurring subscription. The pack size and total price are shown before Stripe checkout. Purchased minutes are added after verified payment, are used after included plan minutes, and remain available until used or the account is deleted. A refund, reversal, dispute, or chargeback may remove the corresponding unused minutes.
Referral rewards: referrers may earn one fixed cash reward from a referred user's first successful eligible Pro payment. The current reward amount is shown in the referral dashboard. A referral may be attributed through a valid referral link or when a new user signs up after opening a course shared by that course's owner and later makes their first eligible Pro payment. Re-sharing someone else's course does not transfer the reward; eligible course-share rewards belong to the course owner. Existing accounts cannot be attached later. A user can generate only one payable referral reward across all referral sources. Rewards become pending after successful payment and are paid manually only after the referrer reaches the minimum shown in the referral dashboard, contacts Examo, and our system verifies the eligible unpaid rewards. If a referred user requests or receives a refund for the first paid Pro payment, the referral reward for that payment is not payable and may be rejected or reversed. We may delay, deny, reject, or reverse referral discounts or rewards where we suspect self-referrals, duplicate accounts, same-card, same-device, same-IP or other abuse, payment reversal, chargeback, dispute, fraud, or any attempt to bypass these Terms.
5. EU Consumer Right of Withdrawal & Refunds
Under the EU Consumer Rights Directive (2011/83/EU), if you are a consumer resident in the EU/EEA you normally have a 14-day right to withdraw from a distance contract for digital services. This right remains available for a new Pro subscription if you request withdrawal within 14 days and you have not used any paid AI services after the paid subscription started.
Immediate access waiver: if you choose to start using Examo's paid AI services immediately after purchase (for example, using the Pro AI Tutor, generating Pro-tier summaries, flashcards, mind maps, cheat sheets, audio summaries, exam practice, or other paid AI outputs), you expressly request immediate performance of the digital service and acknowledge that your statutory right of withdrawal may be lost once the service has been supplied, in line with Art. 16(m) of the Directive.
Withdrawal and refund requests: if you have not used any paid AI service in the first 14 days of a new Pro subscription, contact [email protected] to request withdrawal and a full refund. If we reject a withdrawal or refund request, we will provide valid proof or a clear explanation of the reason for rejection, such as evidence that paid AI services were used after the paid subscription began, the request was made outside the applicable period, or the account is not eligible under these Terms or applicable law. Outside the statutory withdrawal rules, refund requests are handled case-by-case at our discretion.
Statutory rights: nothing in these Terms affects your statutory rights as a consumer.
6. User Accounts
Registration: you must register an account to access most features. Provide accurate, current, and complete information.
Security: keep your credentials confidential and notify us immediately of any unauthorised use at [email protected]. You are responsible for all activity under your account.
One account per user: accounts are personal to you. Sharing logins, distributing access, or creating multiple accounts to bypass rate limits is prohibited.
7. Acceptable Use
You agree NOT to:
- Resell, sublicense, scrape, or systematically extract Services or AI outputs.
- Use the Services to generate content that is illegal, defamatory, hateful, sexually explicit involving minors, or otherwise harmful.
- Attempt to reverse-engineer, jailbreak or prompt-inject the AI to bypass safety measures or rate limits.
- Submit content you do not have the right to upload (including third-party copyrighted course material that you are not licensed to digitise).
- Interfere with or disrupt the Services, our infrastructure, or other users' access.
- Use the Services to commit academic misconduct in violation of your institution's rules.
Examo enforces these rules with automated and manual review. Violations may result in warning, throttling, or immediate suspension or termination of your account.
8. Intellectual Property
Examo IP: the Services, software, prompts, design, logos, and branded content are owned by Examo or its licensors and protected by intellectual property law.
Your content: you retain all rights to the course materials, notes, essays, and other content you upload ("User Content"). You grant Examo a worldwide, non-exclusive, royalty-free licence to host, process, and display User Content as needed to provide the Services to you.
AI outputs: outputs generated by the AI in response to your inputs (summaries, smart notes, flashcards, cheat sheets, AI Tutor responses, etc.) are yours to use for personal study and academic purposes, subject to your institution's academic-integrity rules. Identical or similar outputs may be generated for other users; AI outputs are non-exclusive.
Limited licence: we grant you a personal, non-transferable, revocable licence to access and use the Services for non-commercial study purposes while these Terms remain in force.
Public and shared courses: if you set a course to Public or share it by link, you additionally grant Examo a worldwide, non-exclusive, royalty-free licence to display the shared course - including its name, description, structure, and limited content excerpts on public directory pages - for as long as you keep that sharing option enabled. You are responsible for ensuring you hold the necessary rights to everything in a course you make public or share, and that publishing it does not infringe third-party copyright (for example publisher test banks or paywalled textbook content) or your institution's rules. We may remove any shared course from the directory at our discretion, including in response to reports. Copyright holders can request a takedown by contacting [email protected] with the course link and proof of ownership; we review and action such requests promptly.
9. AI-Generated Content Disclaimer
Examo's study tools are powered by large language models that can produce inaccurate, outdated, or misleading information ("hallucinations"). You must verify any AI output before relying on it for exams, assignments, professional decisions, or any high-stakes context.
Essay assistance: intended as a writing aid only. Submitting AI-generated text as your own work may violate your institution's academic-integrity rules. Examo is not responsible for any academic consequences resulting from misuse.
AI writing edits: suggested edits are generated for your review and are not applied until you accept them. Generating a suggestion or trying again may use AI credits even if you reject the result; rejecting a completed generation does not restore those credits.
AI Tutor: provides educational explanations, not professional advice (legal, medical, financial, etc.). Mathematical, scientific or formula- heavy outputs should be independently verified.
Practice questions & flashcards:generated from your study material; we strive for accuracy but cannot guarantee correctness.
10. Privacy & Data Protection
Our Privacy Policy explains how we collect, use, and protect your personal data and is incorporated into these Terms by reference. Examo complies with the EU GDPR, UK GDPR, and applicable data-protection laws.
11. Suspension & Termination
By you: you may delete your account at any time from settings. Deletion is irreversible.
By us: we may suspend or terminate your account, with or without notice, for material breach of these Terms, suspected fraud or abuse, or where required by law. Where reasonably possible we will give you advance notice and an opportunity to cure.
Inactive accounts: if you do not log in for 6 months and do not have an active paid subscription, we may delete your inactive account and associated personal study data. Courses you created or owned may also be deleted, which means other users will lose access to courses you shared with them. Payment, tax, fraud-prevention, and security records may be retained where required by law or legitimate business need.
Effect of termination: your right to use the Services ends immediately. Provisions that by their nature should survive termination (intellectual property, liability, disputes, indemnity) remain in force.
12. Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by law.
To the maximum extent permitted by law, Examo, its directors, employees and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or exam performance, arising out of or related to your use of the Services.
Where liability cannot be excluded (e.g. for death, personal injury caused by negligence, gross negligence, fraud, or any liability that cannot be limited under applicable law), our total aggregate liability is limited to the amount you paid Examo in the 12 months preceding the event giving rise to the claim, or €100 if you are a Free user.
Nothing in these Terms limits your statutory rights as a consumer.
13. Indemnity
You agree to indemnify and hold Examo harmless from any third-party claim arising out of (i) your User Content, (ii) your breach of these Terms, or (iii) your violation of any law or third-party right, except to the extent the claim results from Examo's gross negligence or wilful misconduct.
14. Service Availability & Modifications
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the Services for maintenance, security, legal reasons, or to improve the platform. Where changes materially reduce paid functionality, we will notify Pro subscribers and offer a pro-rated refund where appropriate.
15. Third-Party Links & Integrations
The Services may link to or integrate with third-party websites and services (e.g. our payment processor). Their terms and privacy policies govern your use of those services; Examo is not responsible for their content or practices.
16. Force Majeure
Examo is not liable for failure to perform due to events beyond our reasonable control, including AI provider outages, infrastructure failures, war, civil unrest, pandemics, government action, or acts of nature.
17. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. The competent courts of Amsterdam have non-exclusive jurisdiction. If you are a consumer resident in the EU/EEA, you may also bring proceedings in the courts of your country of residence and rely on the mandatory consumer-protection laws of that country. Consumers may contact their national consumer authority or an available certified alternative-dispute resolution body. The discontinued EU Online Dispute Resolution platform is not presented as an active remedy.
18. Changes to these Terms
We may update these Terms. Material changes will be announced by email and/or via in-product notification at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services and may cancel any paid plan before the changes take effect. Any refund or withdrawal right remains governed by Section 5 and applicable law.
